What Happens If I’m Charged With Domestic Violence Assault in New York?

New York does not use a separate criminal charge called “domestic violence assault.” Prosecutors charge the underlying offense, often assault, harassment, menacing, strangulation, or related conduct, and the relationship between the parties affects how the court handles the case.

The court may issue an order of protection, set conditions of release, and require you to avoid contact with the complainant or leave a shared residence.

Do not contact the complainant to explain, apologize, or resolve the matter yourself. That contact may violate a court order or create additional problems.

Matthew Cohan and his team represent clients in domestic violence assault cases and address bail, orders of protection, evidence, and defense strategy from the first court appearance.

Contact a federal criminal defense lawyer promptly before answering questions from agents, bank investigators, or prosecutors. Preserve bank records, emails, and other documents, and seek legal advice about document requests and deadlines. Your attorney will review the allegations, handle communications with investigators, and preserve evidence supporting your defense.

Not always. One lawyer might handle both proceedings, depending on the issues and representation required. The cases follow different procedures, so your attorney should assess how statements and evidence in one affect the other. Matthew Cohan and his team coordinate criminal defense and restraining order matters to maintain a consistent strategy.

State drug charges involve state law and local or state prosecutors. Federal drug charges involve federal law and the United States Attorney’s Office, often with agencies such as the DEA or FBI. The systems use different court procedures and sentencing rules. Federal cases frequently involve trafficking or conspiracy allegations, but the same conduct sometimes falls under both state and federal law.
