What Are the Federal Penalties for Money Laundering Offenses?

A conviction under 18 U.S.C. § 1956 carries up to 20 years in federal prison. A conviction under 18 U.S.C. § 1957 carries up to 10 years. Prosecutors often file multiple counts based on separate transactions, which can increase the potential sentence significantly.

Federal money laundering penalties also include fines of up to $500,000 or twice the value of the property involved, whichever amount is greater. Courts can order the forfeiture of funds, property bought with those funds, and assets used to facilitate the alleged offense. Civil forfeiture can also put property at risk before a criminal conviction.

The sentencing guidelines consider the underlying criminal activity, the amount of money involved, sophisticated methods, and the person’s role in the alleged scheme. Related charges can add further exposure.
